[cheers and applause] earlier today the president and first lady got out of their limo and walked along part of the parade route just as they did four years ago. police tell us they did not have an official crowd count. one inauguration official estimates a million people watched the president's ceremonial swearing in today. >> i barack hussein obama do

faithfully swear that i will faithfully execute the office of president of the united states and will to the best of my ability preserve, protect and defend the constitution of the united states. so help you god? >> so help me god. >> congratulations, mr. president. >> shepard: of course the actual inauguration was yesterday to keep everything constitutional. the president took the official oath of office in a private ceremony at the white house. so today was just for show. for all of us. and whatever you think of washington, this town certainly knows how to put on a show. ladies and gentlemen, the president of the united states barack h. obama. a live look at one of the inaugural balls where we are expecting the president and first lady to hit the dance floor later tonight. let's begin team fox coverage with the chief white house correspondent ed henry who is live here in d.c. tonight. also the day the nation honors dr. martin luther king jr. and the president said he really drew inspiration from dr. king and abraham lincoln for today's speech, ed. >> that's right, shep. you heard the president citing both of them, talking a lot about civil rights and really casting himself as someone who wants to carry on their civil rights legacies. i think the broadered message of that what it means in the current political environment is he made very clear that he just didn't win the last election. he believes he has a mandate. he believes he is going to be very aggressive in the days ahead. he was talking about taking action on climate change, immigration reform and at a time when everyone in washington is talking about debt and deficits. he also gave a very rigorous defense of entitlement spending, take a listen.

>> the commitments we make to each other through medicare and medicaid security, these things do not sap our initiative. they strengthen us. [ applause ] they do not make us a nation of takers. they free us to take the risks that make this country great. [ applause ] >> now, interesting as well that the white house put out a tweet about another part of the speech where he said, quote: our journey is not complete until our gay brothers and sisters are tweeted like anyone else under the law. what's significant about this it's the first time any u.s. president has used the word gay in an inaugural address. you will remember it was only a few months ago the president came out in favor of same sex marriage. that was a change for him. he now is making clear that gay rights will also be part of his second term agenda, shep. >> shepard: what are we getting in the way of reaction to this speech, ed? >> well, look, republicans are

going to be a little bit nice today. that's what the tradition is on inaugural. the president started his day as every president. republican has fdr saint john's church across from lafayette park where we are now. they had a little prayer service. the pastor there talked about how the president has a responsibility to try to bring the country together. in fact, he sat down for lunch. signed some papers with the democratic and republican leaders up on the hill. and republican senator rob portman said that maybe there is a window of opportunity here in the next few months for both sides to work together. take a listen. >> both parties need to figure out a way to work together to solve big problems. for democrats, frankly, they are going to need some help from the president laying out what the issues are to the american people and providing them the ability to do what they know needs to be done. >> so, everybody is playing nice, perhaps. but a reporter asked senator portman, who was obviously a key advisor to republican mitt romney back in the campaign

how long do you think this niceness will last? portman looked down at his watch as if to say well, maybe a few minutes. the chances are after this pomp and circumstance. after the president and first lady have those dances tonight at the inaugural ball both sides will be going back at it. >> shepard: more clock than calendar for sure. ed henry our main man at the white house. after the streets are cleaned and cleared and the parties are all over we are back to the grind. among the first orders of business this week, an important house vote on raising america's borrowing limit. mike emanuel with the news on capitol hill tonight. we learned a lot about bipartisanship today that spirit of cooperation as ed put it it's a watch thing not a calendar thing. >> well, shep, true. you have the same key players at the white house and here in the united states congress. today when the president spoke to the nation and to lawmakers, his tone was assertive. >> we cannot mistake absolutism for principle. or substitute spectacle for politics or treat name calling

are a reasoned debate. [ applause ] we must act, we must act knowing that our work will be imperfect. >> top senate republican mitch mcconnell called the president's second term a fresh start. he called it a fresh start when it comes to dealing with the big issues of our day. he called some government spending and debt and mcconnell says that republicans are eager to work with the president, shep. >> shepard: some of those republicans are saying they are hoping to hear more from the president about the ig issues. issues like the ones have you mentioned. >> that's right. to be clear i asked a lot of republicans to go on camera with us today. they seemed a little camera shy, perhaps wanting to give president obama his day. but one key senate republican said he wishes the president had spoken more about the need to reform medicare, medicaid and social security. >> unfortunately, right now, we have a situation where it

is generational fest. we are leaving our kids and grand kids with incredible burdens of debt and deficit unless we reform these important programs. i think the choice the president ought to be laying out instead and ought to be telling the american people yes, we can do. this we can even improve these programs in certain important ways but we have to address it. >> the senator from ohio says he wishes the president had given more examples of areas where republicans and democrats could work together, shep. a major test coming next week. >> that's right. you have got the house is going to take up later this week as a matter of fact on wednesday. they are going to vote on increasing the nation's borrowing limit the debt ceiling as it is called. okay wednesday they are going to do that vote. the senate pass a budget with spending cuts in it. that is when the kum ba yah the happy talk here on capitol hill may go back to a little more firstier talk.

what's in your wallet? here's your invoice. >> shepard: getting started here in d.c. as the nation's capitol celebrates president obama's second inauguration. of course, as we have mentioned repeatedly, tomorrow it's back to business for the white house and congress battling over the budget among other things. dana perino is is with us in new york. fox news contributor, former white house press secretary under president bush the 43rd. current host of the five here on on fox news five. >> also a ghost. >> shepard: i feel like one with these streetlights above me. i'm curious about legislative

agenda. immigration reform. your boss bush the 43rd made lots of inroads in that way. the question is is now will the tea party caucus allow that sort of reform to happen this time. what do you think? >> i actually don't think it's a tea party necessarily that president obama or anyone who wants to get something done needs to worry about. i actually think that the problem is more on the left. they are going to want more than they are going to be able to get. the opportunity right now would be to call senator marco rubio in florida. if you look at their two proposals, they are not that far apart. if you wanted to solve this problem for the purpose of economic growth, more border security and to do what president obama wants, which i don't think is not -- he is not the only one who wants to provide to provide assurance younger people by parents if they were brought here illegally. i think if they were to bring in marco rubio they would get

something nonpartisan done. other aren't that budget, i don't think there is a lot through this congress. they haven't passed a new budget in four years. a lot of new faces in washington as well especially on the senate side. >> shepard: sure. the polls suggest that the american people have moved a lot on gun control, at least since the tragedy at newtown. i'm wondering if you think there is any room for gun control legislation? be it smaller number of ammunition in magazines or the gun show loophole or anything that's possible? >> i thought that before president obama did the 23 executive orders that he signed last week that he might have been able to get some sort of bipartisan legislation done on that. however, the problem he has is a little bit on the right but a lot of those centrist democrats, they don't want to have to vote on this problem. so i don't think that you are going to see senator reid bring this bill to the floor

and the house is smart. republicans say don't send it over here first. let's see what you can get through the senate first. my prediction is they will not put anything through the senate. >> dana, the 57th time that we have had an inauguration night. you were part of them. i wonder what it is like for those who worked so many hours and so many saturdays and sundays and days in a row. what a day like this is like for folks inside the building behind me. >> i'm really happy for them. i just got some goose bumps because i remember taking my niece who was 18 at the time. i took her to the inaugural it was so cold. i'm glad that they had better weather this time even though it's cold. it's nothing like it was in 2004. we had those little warmers in our boots and were hobbling around. and that was -- it was a beautiful moment. and to see the pictures today, the overhead shots of the huge million-person crowd that gathered to see the inaugural, that always is inspiring as an american. and i think tonight the only advice i would have for all of them is wear comfortable

shoes. [ laughter ] >> shepard: never wear heels. i remember four years ago as president bush was leaving office, president bush the 41st who thankfully is at home and recovering tonight came into the pressroom and we were all standing around and he went reporter to reporter to reporter and shook hands and said this may be the last time i'm in this room and i wanted to say hello to all of you and thank all of you and now president bush the 41st is recovering at home after a long bout. i know you know the family well how is he? >> is he doing much better. is he is such tender-hearted person that the only thing that he was very concerned about the first day it was announced that he was at the hospital, there were over 350 phone calls within two hours at the hospital. and he wanted to call everybody back and thank them. he felt so guilty that he couldn't. so perhaps i could take this opportunity to thank everybody for him. is he a wonderful man. it was great to look at that history. he and president bush 43 both

>> murder of entire family and reportedly sent a photo of his dead mother to a girlfriend. they tell us it happened on saturday night in new mexico at a home south and west of downtown albuquerque. five dead all together. five including the suspect's brother but nine years old and two sisters, ages 5 and 2. >> the victims all apparently suffered multiple gunshot wounds. multiple weapons were apparently used, including one assault rifle. however, all of the dynamics of that is clearly still pending the results of our investigation. >> the accused killer murder

charges while people who know his family are mourning their deaths. william la jeunesse is live in our west coast newsroom this afternoon. william? >> he told police he was annoyed at his mother on friday night. after she went to bed, he allegedly pulled a gun from the closet and killed her. when younger siblings woke up, he shot them as well as his father greg who arrived home early that morning. now, greg was a volunteer chaplin for the albuquerque fire department and county jail but had recently left the job as a pastor at a large christian church there. nehemiah reloaded on saturday and told police that he hoped to, quote, murder more people and die in a shootout with police. his story began to unravel after telling a security guard at his father's chapel that his parents were dead. several times he lied about how they died. including a car accident. even though, according to the albuquerque journal that he already texted a photo of the murder scene to his girlfriend. >> every case is unique.

i have seen homicide scenes. i have never seen a shot like this. >> it's a shock when something like that happens to slows to your home. >> nehemiah was home schooled. he typically wore army fatigues. was not allowed to play video games. he wrote i'm a fun loving guy who likes to make people happy. i might be shy but i open up once you get to know me. he could be tried shepard as an adult on multiple counts of murder. back to you. >> shepard: william la jeunesse in los angeles. american and japanese investigators visiting the battery maker that supplies boeing's deem liner jets. airlines around the world grounded those planes after a series of problems. including one last week in which an overheated battery forced an emergency landing. you can see that scorched battery on the left right there next to an undamaged one on the right. investigators from the federal aviation administration were among those who visited the battery maker's headquarters in japan. a company spokesman says they are trying to determine whether there were problems with the battery's parts or

plant in algeria did kill three americans: according to the prime minister. two canadians and team of explosive experts who had planned to blow up the place. the prime minister also said the military operation to free those hostage resulted in the deaths of dozens of prisoners. you will recall last week the militants stormed the facility near the lib i can't be border. according to the al gearian they claim it was pay back for algeria letting french jets use airspace to attack infamous fighters in neighboring mali. jonathan hunt has this in new york tonight. jonathan, last week we had a lot of criticism of the algerians. there seems to be a change in tone now. >> yeah, very much so. last week the british and japanese governments in particular were very critical of what they saw as an overly aggressive and heavy handed response by the algerian security forces.

in going in with helicopter gunships and large number of special security special service operators to try to take on the attackers. the u.s. government was very careful in its wording though last week and today a statement issued in the name of victorian newland the state department spokeswoman said in part as the president said the blame for this tragedy rests with the terrorists who carried it out o. and the united states condemns their actions in the strongest possible terms. we will continue to work closely with the government of algeria to gain a fuller understanding of the terrorists attack of last week and how we can work together moving forward to combat such threats in the future in that same statement, ms. nuland confirmed those deaths of three americans as a result of this attack. shep? >> shepard: jonathan, this crisis in algeria really a prime example of how

international events can really overshadow a domestic agenda. >> president obama's inauguration speech today was long on domestic policy, very short on foreign policy. a declaration that a decade of war is coming to an end and this. listen. we will support democracy from asia to africa to the americas to the middle east because our interest and compel to us act on behalf of those who long for freedom. >> just a couple of sentences on foreign policy. there are many potential challenges ahead for president obama. the ongoing civil war in syria, the ongoing nuclear ambitions of both iran and north korea. and, of course, the rise in islamic extremism. the algeria hostage crisis just the latest example of that. and those militants have vowed more attacks on the french and anybody else who supports their military campaign in neighboring mali.

and, of course, the u.s. is supporting that campaign. so, remains in the eyes of these militants an ongoing target, shep. >> shepard: jonathan hunt in new york tonight. jon, thanks. as the clouds flock to d.c. today for the inaugural event, folks lined up extra early along traditional parade route to the white house. ♪ ♪ >> shepard: floats, marching bands, musicians, other performers, 8,000 in all. all part of the action. the president and the first lady watched from their viewing booth on pennsylvania avenue just behind me. and while officials say the crowds were smaller back in -- than back in 2009, they also say more people than expected came out for a first-hand look at the celebrations here. john roberts was along for the ride. is he in lafayette park just

across the street from the white house. john, today you followed the parade route the entire way on a flatbed truck and it looked like the time of a lifetime. >> it really was, shep. this is the fourth inauguration i have covered. i covered the white house for seven years. and this was the most funny have ever had at an inauguration. you know, this inaugural parade is one of those moments, one of those opportunities that is as much for the people who are -- as it is for the president. it also gives a chance to the newly sworn in president to get out and actually get close to some real folks: couple of times during the parade he and michelle obama got out off the limousine and walked for a couple of blocks. floats go by. on the national mall today. no official estimate of the crowd count. we haven't heard from the u.s. park police yet. one inaugural source told us that there were more than a million people out on the mall today. and if that number holds, not only is is it more than they expected to come out but it would easily count as the largest crowd ever for a

second inauguration. we talked to plenty of folks out on the mall and along the parade route today to get their thoughts on today's celebrations. here is what they told us. >> it was just as inspiring and invoking in terms of, you know, its tone, its presence, and, you know, the ceremony of what it was, definitely 2009 was much larger. >> i think certainly tonight less sort of you fork. the history that was made in 2009 certainly couldn't be recreated. i think this occasion was more of a subdued but sort of confidence affirming kind of ceremony. >> the president is is doing his best. and i'm sure this time he probably doesn't have the same support, but he has the same support from us. >> and in his inaugural address, president obama reached out to people like that, his supporters imploring them to get behind his second term agenda, hoping to enlist the considerable enthusiasm for his presidency that was on display today.

and turn that into a very powerful political weapon for his second term. shep? >> shepard: john roberts down on pennsylvania avenue. thank you very much. the supreme court justice anthony scalia's unusual hat got some notice at the inauguration today after senator clair mccaskill tweeted about it with the hash tag scalia weird hat. virginia law professor custom made replica of the hat in this portrait of 16th century lawyer saint thomas moore. there were plenty of other note worthy head gears including justice breyers somewhat understated skully and senator happen's big white cowboy hat. none as memorable as aretha franklin's inauguration hat from four years ago. it was quite something. a lot of people will be looking to see what the first lady wears tonight. we will have an official preview of the inaugural ball. not one but two correspondents live and on scene.

what they always are now to the aforementioned team fox smooth r. smother raj. peter doocy joining us life from the floor of the washington convention center. hey guys. >> hello, shep. >> shepard: besides bangs, we already know about that molly, what do we know about what the first lady will be wearing tonight. >> that's a secret right up there with the nation's nuclear codes right now that and the song of the first dance. it does have some significance because the first lady's dress here at the inaug usually donated to the smithsonian. that's why there is a lot of curiosity about it. you may remember in 2009 she wore a white one shouldered think upon dress by a then somewhat unknown 26-year-old designer jason roo. her husband said she was very good looking in 2009. i'm sure he will say something like that today. last first dance beon is is --

beyonce's last dance. >> shepard: who else is performing tonight? >> it's a lot of stuff that you would hear if you got in your car and turned on the radio right now. alicia keyes. stevie wonder. john legend. who is the band fun. we are in a big 473,000 square foot basement. and we expect about 20 minutes from now to see a lot of dancing. even though people are really dressed up like molly and i and the floor is concrete which i guess would really only be bad news if you wanted to do some tap dancing tonight. we don't have any numbers on tap dancers tonight. >> shepard: i wouldn't expect that you would get that molly, this is very much scaled back from 2009. it seemed like balls were all over town back then. >> yeah, good memory. there are only two official inaugural balls this year. they are both in this building. that's compared to 2009. there were 10 inaugural balls spread out as you were saying all over the city. they are about as far as the capacity of this facility. they will be about the same as

2009. about 40,000 people here tonight. they will come and do their first dance at all the balls and head home after a long day. one historical note four. the first inaugural ball here in washington was in 1809 when president and dolly madison hosted 400 or 500 people in a hotel and the tickets then were $4 each wow. last but four years ago. will we hear from the president? we heard from him over and over again. what about tonight? >> we are going to hear from him, shep, at that commander and chief ball. the commander and chief ball is a tradition that was started by president george w. bush. there is going to be about 4,000 members of the military who all got free tickets and really cool thing that's going to happen once again is that the president and the first lady are going to dance with two very lucky members of the military. i talked to staff sergeant rhea nelson. she gets to dance with president obama on the first full day of his second term.

i asked her how she was feeling. she said that she was nervous and excited equal parts. she also said that she was not going to step on his shoe. she was sure. molly, only two official inaugural balls tonight. a bunch of official ones. the vice president is supposed to attend one of those, right? there is a one of them around town. put on by the american legion. since the 1950s. tribute to the 81 men awarded the america's highest military honor. the congressional medal of honor. the vice president and his wife are expected to go to that unofficial ball early this evening. how do you score a ticket. >> big one we are in basement concrete floors are open to the public. the tickets started at $60. obviously sold. big money donors as well.

i look around, all kinds of people since it was open to the people. ticket to it red skins game. can i report that even though it has not started yet. it has started to get a little warm in here. that's notable back in 1857 for president buchanan's inauguration for ball. they had it in a temporary shelter. so cold that the can a canariesy had all over the place froze and died. in here much warmer about. >> to get warmer when you get out there and start dancing. >> it is. if i starlight dancing my odds of getting tased ten fold by the secret service. >> you are relatively tall guy. i'm guessing you are standing on something, aren't you? >> yeah. we can show you what it is like if i stepped off the box. it looks a little bit more legalistic.

>> shepard: the nation today marking the birthday of the great civil rights leader, the reverend dr. martin luther king jr. his daughter, dr. bernice king spoke this morning during commemorative service at ebenezer baptist church in atlanta. here in d.c., the nation's first african-american president paused today at the statue of dr. king in the cap fall row it ungra dra. earlier he had taken the oath of office using two bibles. one of which belonged to the civil rights leader. the other belonged to president abraham lincoln. president obama made history today as the first president ever to speak about gay rights at an inauguration. and he did so by comparing the struggles of gay americans to what women and people of color have endured over the years. james rosen live in our d.c. newsroom with more on this. hey, james. >> shep, good evening. with this pivotal address president obama effectively positioned himself as more than just a president or chief executive. he appeared at time to be seizing the mantel of the

civil rights leader whose birthday was observed as a federal holiday today. the reverend doctor martin luther king jr. >> we, the people, declare today that the most evident of truths that all of us are created equal. is the star that guides us still just as it guided our forebearers seneca falls and selma and stonewall. >> seneca falls site of the first women's rights convention held in 1848. selma, of course, was the city in alabama where state troopers in march 1965 savagely attacked african-americans marching for african-americans. stonewall the gay bar in greenwich village violent. seen as the birthplace of the gay rights movement. >> here we have a black man being reinaugurated. his hand resting on lincoln's bible. his hand in turn resting on

martin luther king's bible. that's a very stirring site. but this nation has made great progress in those issues. i felt this speech had echos of something that could have been written 50 years ago. >> this was only the second time a public inaugural was held on dr. king's birthday. the first time was in 1997 for president clinton's second inaugural. shep? >> shepard: james rosen here in d.c. tonight. james, thank you. some breaking news just coming in to us and a live look at denver international airport from our afilm i can't tell kdav there we're told that southwest airlines jet had to abort takeoff toted when a warning signal went off. officials there say that the jet had what they call hot brakes and ended up blowing three tires. the warning signal was a fire indication but there was no fire on board. 137 passengers and five crew members there no injuries reported.
